Cabinet Pisas scraps tax assessments from 2017 and earlier

Legal certainty requires that a tax debtor cannot be forced to pay after a very long time without the Tax Collector of Curaçao taking timely action.

That is why the legislator has determined that tax debt in principle lapses five years after the date of the assessment. This means that the Tax Collector of the country of Curaçao may no longer institute legal proceedings to force the debtor to pay.

In November, the Treasury Department set aside 235,000 tax assessments due to the statute of limitations. The almost 475 million guilders of these assessments are no longer collected.

A taxpayer must formally submit an appeal on prescriptive period, but it has been decided to pro-actively exclude collection of the time-barred assessments. This gives the Tax and Customs Administration more room and capacity to process the current assessments.
